TERMS & CONDITIONS
These terms and conditions form the agreement between Ida May (“the Photographer”) and the Client.
Confirmation of a booking, whether written or verbal, constitutes acceptance of these terms.
BOOKING & PAYMENT
A £100 deposit is required to secure your session.
The remaining balance is due on the day of the shoot at which point the Client must also sign the Client Release.
Bookings are not confirmed until the deposit has been received and the Photographer has accepted the booking by scheduling the time and the location for the shoot.
CANCELLATION & RESCHEDULING
• Cancellations made 48 hours or more before the shoot — deposit refunded or transferred
• Cancellations within 48 hours — deposit is non-refundable
• Failure to attend the shoot — full fee is payable
Rescheduling may be possible subject to availability; additional fees may be payable. If it proves impossible to reschedule because of the Client’s lack of availability, the deposit may be retained.
In the unlikely event that the Photographer cannot make the scheduled time for the shoot, the Client may at their discretion request either a full refund or agree to a new time. No other liability can be accepted or remedy offered.
THE SHOOT
Shoots are typically between 90 minutes and 2 hours, depending on the nature of the shoot. This time commitment is dedicated to you.
Each shoot is intentionally unhurried, and we intend to work until the required images have been achieved. However, it may not be possible to extend the time dedicated to you and/or the shoots may have to conclude earlier due to factors outside the Photographer’s control, limits on the location and/or natural light, the Photographer’s other commitments, if both Client and Photographer agree or for other reasons. Late arrival may also reduce shooting time.
CREATIVE APPROACH
The Client acknowledges that they are familiar with the Photographer’s style and approach.
All images are created and edited at the Photographer’s discretion, reflecting their artistic judgement.
While every effort is made to capture the Client’s preferences, no specific image, pose or outcome can be guaranteed.
The Client is responsible for communicating any requirements or preferences prior to and during the shoot.
There is no right to reject images whether based on style, composition, editing or any other reason. The Client acknowledges that they are paying for the Photographer’s time and not a particular, guaranteed product.
IMAGE DELIVERY – WHAT YOU CAN EXPECT
The Photographer intends to deliver a private online low resolution proof gallery within 48 hours of the shoot. The Client acknowledges that this gallery will not include every photograph taken during the shoot.
The Client agrees to make their selection in a timely manner and in any event within 14 days of the shoot.
Final retouched images are delivered within 7–10 working days from selection.
Selected images are delivered digitally in high resolution.
WHAT IS INCLUDED FOR THE MONEY YOU PAY?
As well as the experience of the shoot itself, you are paying for the Photographer’s time before, during and after the shoot with the intention, and subject to the Photographer’s creative approach, of delivering 3 retouched images.
Given the Photographer’s creative approach, retouching is natural and minimal.
Additional retouched images may be selected and are charged at £25 per image.
Once retouch selections have been submitted, they cannot be changed or cancelled.
Further retouching requests (whether of images already delivered or in respect of additional images) are undertaken at the Photographer’s discretion and may incur additional charges.
COPYRIGHT & USAGE
The copyright in the images is owned by the Photographer and you acknowledge this by signing the Client Release.
The Client is granted a licence to use only the final retouched images for personal and professional use (including casting platforms, websites and social media). The images may not be sold, licensed or otherwise exploited commercially. If you are a brand wanting to license images for advertising, we need a separate agreement which may include additional fees.
The Photographer asserts their moral rights. This means that the Photographer has the right to be identified by name as the person who took the images. This is usually done with a copyright notice “© Ida May [year]”. It also means that no one else can claim to have taken the images.
Images may not be altered, filtered or edited without the Photographer’s written permission and should not be subjected to any derogatory treatment. In particular, the images should not be uploaded into or subjected to any AI treatment.
Unedited or raw images are not supplied because the Photographer retains the right, in their sole discretion to cut, edit, copy, add to, take from, adapt and/or translate the images as they see fit and you waive the benefits of and agree not to assert any applicable laws known as “moral rights” or any similar rights which you may have.
In retaining the copyright, the Photographer has right to use images for portfolio, website, social media, exhibitions, competitions, publications and/or promotional purposes (among other things).
SOCIAL MEDIA
When sharing images online, they must not be altered, cropped or otherwise edited and credit “© Ida May [year]” should be included.
The Client is responsible for ensuring that any third party sharing the images also complies with these terms.
LIABILITY
In the unlikely event of a problem, the Photographer will always try and sort things out but if that isn’t possible, they won't compensate you for all losses caused by them or their services.
The Photographer is not responsible for losses you suffer caused if there is a breach of this agreement if the loss is:
Unexpected. In the law, the loss was unforeseeable.
Caused by a delaying event outside our control. This includes because of illness, accident, equipment failure, corruption of image data and technical failures.
Avoidable. Something you could have avoided by taking reasonable action, including following our reasonable instructions.
Down to you. the Photographer is not liable for travel costs or other expenses incurred by the Client due to changes or cancellations.
The Photographer does not seek to exclude liability for death or personal injury caused by their negligence or loss caused by their fraud.
In order to deal with any problems, the Photographer may choose to refund all payments which is the maximum liability in any event.
The Photographer can withdraw their services if they deem that the Client has acted inappropriately towards them or fails to cooperate with them in which case no refund is payable.
RESHOOTS
Reshoots are at the discretion of the Photographer and are chargeable.
Reshoots will not be offered due to styling choices, hair, make-up, or failure to communicate concerns during the session.
ARCHIVING
Client images are stored for 6 months after the shoot.
After this period, files may be permanently deleted.
Clients are responsible for downloading and backing up their images.
GENERAL
All bookings are subject to change in the event of unforeseen circumstances.
Any breach of these terms and conditions will result in the termination of the licence to use the images.
The Photographer necessarily collects your personal data at various times including when you book the shoot and in the creation of the images. You give your consent to use of your personal data for the provision of the services and in order to allow the Photographer to use the images for their own purposes whether in the UK or overseas.
You can only transfer your booking with the Photographer to someone else if the Photographer agrees to this.
Nobody else has any rights under this agreement. This agreement is between the Client and the Photographer. Nobody else can enforce it.
The rights and permissions granted by you to the Photographer under these terms and conditions are in perpetuity, irrevocable and unconditional and survive termination or expiry of this agreement.
Governing Law and jurisdiction
These terms are governed by English law and subject to the exclusive jurisdiction of the English courts.
